We all know that shops reluctantly agree to return money for low-quality goods. Moreover, they often deliberately sell defective shoes and clothes at the price of high-quality things, so by returning you obviously spoil their plans. But the law is on your side - find out how you can return the defective goods back and what to look for when buying things.
What are the defects
By law, the seller has no right to sell the poor quality product to the buyer. What kind of clothes and shoes are considered as such? First of all, items that cannot be used for their intended purpose - to wear, and those whose actual size does not correspond to the size indicated on the tag are considered defective. And, of course, things are considered a marriage that are either sold with the presence of external defects, or these defects appear after the start of operation of the goods.
Defects of clothes and shoes include:
- deformation of parts;
- uneven color;
- instability of the color of the material, its marzime;
- damage to the fabric or seam;
- hardware breakdown, etc.
There are these types of defects in clothing:
- The defects of modeling are those that arise at the initial stage of manufacturing things and are associated with the design and choice of materials for a particular model.
- Errors in the design phase of clothing lead to structural defects. This includes improper planting of the product, the appearance of folds, wrinkles, corner wrinkles and distortions. To get rid of these defects, low-quality goods need to be redrawn.
- And those defects that have arisen at the stage of its manufacture are called technological. This is a stitched stitch, curved stitches or edges, missed stitches, peeling materials, etc.
How to detect the marriage of clothes or shoes
When inspecting shoes, pay attention to whether there are glue stains, holes, cracks, folds, and in general any mechanical damage, whether it is a straight line. Check whether all the buttons hold tight, and lightning work. There should be no defects on the inside of the shoe: make sure that no braces stick there, the heel does not sink, and there are no folds on the lining.
A pair of shoes should try on and walk around the store in it - if you are at least uncomfortable in it, then refuse to buy. If the shoes are comfortable, but you are afraid that the flaws may emerge later, check with the seller, under what conditions it is possible to return the goods to the store and how much the warranty is valid.
Do almost the same thing when choosing clothes: carefully inspect it for external and internal damage, assess the quality of tailoring, the uniformity of color and its marzime, the reliability of accessories. How to return defective goods to the store
In this situation, the Law “On Protection of Consumer Rights” (Article 18 of the Law of the Russian Federation / Article 8 of the Law of Ukraine) works in your favor. Return of goods to the store is carried out during the warranty period, if it was installed by the seller. If there is no warranty period, the buyer can return the defective product back to the store within two years.
The seller is obliged to take the defective goods back and compensate the buyer for damages in the amount of the full value of the defective item. Also, the buyer may require the elimination of defects at the expense of the store or the replacement of a marriage with new shoes or clothes (either from the same company or another one with a recalculation of the cost). In this case, the rights of the consumer are violated in the case when the repair of the product lasts over 45 days.
If a dispute arises between the seller and the buyer about the origin of the defect, the only way out is to conduct an independent examination of the quality of the clothes, which will show whether the production is a marriage or the result of improper use by the buyer.
If necessary, to be able to protect your consumer rights in court, contact the store with a written claim in 2 copies, on one of which indicate exactly when your application was received.
